Well the rule book states he should be suspended because he received a 10 minute misconduct penalty, and it was within the last 5 minutes of the game. I think an Instigator penalty is also grounds for suspension under the same conditions.

He will be suspended for the rest of the summer once the B's knock them off Tomorrow Night!!!

I didn't read the details of the penalty time, but after the misconduct and instigator under the 5 minute mark..I can't believe the NHL made an exception for this, what an absolute joke.
